Gujarat CM’s people-welfare oriented decision: Non-Creamy layer certificate to remain valid till three years

Under the State Government, for the purpose of admission in educational institutes and for applying in government, semi-government and panchayati raj jobs from class 1 to class 3, socially and educationally backward classes have to obtain a Non-creamy layer certificate for availing benefits of reservation. According to the current norms, following 6 parameters have to be fulfilled to avail a Non-Creamy layer certificate.

1) Constitutional positions 2) Service level 3) Military positions 4) Trade, industry and professional classes 5) goods and assets bearer 6) Income and wealth

In the event of an admission/recruitment considering the difficulties faced by administration and applicants in obtaining a Non-Creamy layer certificate due to complicated administrative procedures, the government according to a resolution made on 15/06/15 had decided that out of the 6 total parameters, the income certificate will remain valid for a period of three years. In spite of the above liberal policy, students/applicants requested CM Smt. Anandiben Patel that considering all the above 6 parameters, it is necessary that the certificate remains valid for a period of 3 financial years instead of being valid for a year. As a result, the state government passed a resolution detailing that a Non-Creamy layer certificate taken for 1 purpose will be admissible for any other recruitment/reservation purpose for a period of 3 financial years.

An authority has been appointed in the presence of Mamlatdar and Taluka Development officer to hand out Creamy layer Certificates at taluka levels. But to avoid the rush that occurs for procuring such certificates during the results of standard 10th and 12th exams and also during the recruitment process of class-3 to class-1 officers, District Deputy Director/District Social Welfare Officer have also been authorized to hand out the certificates.

It is worth noting that due to the government’s decision roughly 3 crore OBC population of the state will find it easier to procure the certificates. It is estimated that over 6 lakh such Non-Creamy layer certificates will be handed out this year. Also, this policy will only be applicable to the reservation process under the state government. The policy related to reservation in Central government jobs remains unchanged as it falls under the jurisdiction of the Indian government.
